durhs_v1 Drinking from a Locked Trunk: The Legal Boundaries of Open Container and DUI Laws This paper examines the legal complexities of consuming alcohol via a tube from a container locked in a vehicle’s trunk. Through a comparative analysis of statutes in Texas, California, Florida, Michigan, and Louisiana, it demonstrates that current open container and DUI laws, which focus on physical accessibility and impairment, do not clearly prohibit such conduct. Drawing upon textualist principles—most notably Justice Scalia’s admonition against judicial policy-making in Chisom v.
